The corporate income tax should match the highest personal income tax rate at 25% to be competitive with other Asean states. The personal exemptions should be adjusted based on the cost of living.</div>

Excise tax. Maintain most rates but continue broadening the tax base. This is to encourage production and consumption of healthier products. The minimum by value excise tax on automobile should be increased from 2% to 10%. There should be a by volume excise tax on automobile based on length with the minimum rate at 10% of the value. This is to discourage purchase of cars which add to traffic and to encourage use of public transport.</div>

Payroll tax or contributions to social security, health insurance and home fund. These are flat rate or progressive bracket-based taxes but with caps and no exemptions thus effectively regressive. To simplify, increase compliance and be constitutional, levy a low flat rate tax with exemption and no cap. The social security contribution should be lowered from a nominal rate of 11% to 6% shared equally by the employer and employee; the health insurance from 2.5% to 2% shared equally; the home fund from 4% to 2%. The lower rates will be compensated by removing the caps. The exemptions should be based on the cost of living automatically adjusted every 3 years so cost of living income individuals does not need to contribute but are still covered.</div>

The Philippines and Indonesia had our overlapping EEZs delimited through a bilateral agreement in 2014. The Philippines and Malaysia should have our overlapping EEZs delimited through a bilateral agreement. The Philippines, Indonesia and Brunei should join and cooperate in the submission of Vietnam and Malaysia for extended continental shelf (ECS) in the South China Sea. The application for ECS, if granted, should be delimited equidistantly from the five ASEAN states' EEZs. These should be done notwithstanding our claim on northeast Sabah to strengthen our position that UNCLOS and the tribunal ruling is not about sovereignty and to show unity among coastal ASEAN states. Vietnam should also file a case to the Permanent Court of Arbitration regarding the status of islands and features of Paracel to clarify if any is entitled to an EEZ.<br />

I had a three hours free time before the next class. I have to do something to kill time. Good thing this guy from an online app texted me. He's from Montalban. He looks cute on his profile picture. We then discussed over text how to get to his place. I calculated if I can get there and back in time for my next class, although I haven't really been to that part of Montalban.<br />

I proceeded out of the building and catch the next Ikot jeep thinking of the best route to get to the first point on his directions. After a few minutes, I hopped in another jeep to get to Philcoa. From there, I looked for any Fairview jeep to get to Litex.<br />
<br />
He told me to look for an Urban jeep or Erap City jeep somewhere around Litex market. I know that route will get me to Payatas but he told me their place is even beyond Payatas. He texted again to check where I was. I told him I'm confused which jeep to ride.<br />
<br />
There were Payatas and Erap City/Urban jeeps. I just rode the latter. After a minute, he told me the route should be Suburban. I asked a passenger if that was the correct jeep. I paid the minimum fare and got off. I crossed the street and rode a jeep going to the opposite direction.<br />
<br />
I asked around and learned that the Suburban jeep terminal is at Commonwealth market just across Litex. It was midday and hot and it was crowded but not heavily as rush hour. After walking a distance and asking some more, I finally found the correct jeep.<br />
<br />
He continued texting to check where I was. The jeep passed by Payatas where lots of dump trucks still enter. It did smell awful but only for a minute in that entire ride. I could now see the lake-like La Mesa watershed on the left. After fifteen minutes, it already feels suburban with the residential subdivisions left and right. I was following the entire ride on my Maps app so I knew the green mountains of Montalban would be next on the right.<br />
<br />
Half an hour more when I saw the landmark where I was supposed to get off. It is the terminal anyways so I just waited for the other passengers. He said he will be waiting near the terminal. I immediately saw him in the color of the clothes he was wearing. He was holding an umbrella. He is fat compared to his picture and quite flamboyant. There was still some time to look around so I agreed to follow him to his place. And I was hungry too.<br />
<br />
We walked past townhouses and apartments and a basketball court before entering a smaller compound. There was a small Iglesia ni Cristo chapel around the corner just before his place. I asked who were with him. He said he's alone now that his family was out until evening. He pointed the gated lot across the street which he is an events organizer. It was their family's business and the reason he was very tired last night.<br />

We went inside and let me sit on the sofa. He asked if I wanted to watch a movie. I declined. There was not enough time and I wasn't in the mood either. He sat beside me and become a bit touchy. I stood up and looked around. He asked if I was hungry. I said yes. He began preparing a plate and Adobo. He cooked it earlier and just finished having lunch while waiting for me.<br />

After eating, I asked if I could use the comfort room to poop. It was very spacious which is as big as a room. I liked how they used a plastic storage box as water bucket. I stayed a bit so not be rude even if I was in a hurry to get back to school. I saw a portrait of Manalo beside their family portrait. I played dumb and asked if he was their uncle. He said they are members of INC. In fact, all in that compound are relatives and members as well.<br />

I said I really need to go back. He asked if I don't want to do it anymore. I respectfully declined. He walked me back to the terminal.<br />

My professor questioned me if I have any excuse. I had none. She scolded me for being late twenty minutes. Then a classmate asked where I have been. I told him I've gone to immersion.<br />

My grandpa and grandma who were Erap loyalists brought us there. And my grade school years in nearby La Salle Green Hills were constantly disrupted by these events.</i></span><br />

Magsisimula ang kasaysayan ng pagpili sa pambansang wika noong 1934 nang ginagawa ang Konstitusyong 1935. Sabi ng 1935 Konstitusyon, Article XIV:<br />

Section 3. The Congress shall take steps toward the development and adoption of a common national language based on one of the existing native languages. xxx<br />
<br />
Ang mga delegado sa Constitutional Convention ng 1934 ay binoto ng mga Filipino. 50 lamang sa 202 mga delegado ang galing sa mga probinsyang Tagalog at ang mga leader naman doon ay mga Cebuano kaya imposible na may monopolya ang Tagalog sa Kumbensyon ng 1934. 96% ang naging boto para aprubahan ang Konstitusyong 1935 sa isang national referendum. Walang monopolya ang mga Tagalog sa isang national referendum.<br />
<br />
<a name='more'></a>Sa mandato ng Konstitusyong 1935, inaprubahan ng National Assembly ang Commonwealth Act No. 184 ng 1936 na gumawa sa National Language Institute (NLI). Ang mga assemblyman ay ibinoboto ng mga Filipino kada distrikto. 18 lamang sa 98 mga assemblyman ang galing sa mga distriktong Tagalog at taga-Negros ang mga leader sa asemblea kaya imposibleng may monopolya ang Tagalog sa asemblea.<br />
<br />
Sabi sa batas na ang pangulo ang pipili ng mga miyembro sa NLI na dapat galing sa iba't-ibang ethno-linguistic groups sa bansa. Sabi pa na pag-aaralan ng NLI ang mga wika sa bansa at pipili nang magiging basehan ng wikang pambansa. Walang magagawa si Quezon kundi sumunod sa batas dahil siya ang naging pangulo.<br />
<br />
Ang napiling mga miyembro ng NLI ay sina:<br />
Jaime C. de Veyra (Samar-Leyte Visayan), chairman;<br />
Santiago A. Fonacier (Ilocano), miyembro;<br />
Filemon Sotto (Cebu Visayan), miyembro;<br />

Malinaw na walang monopolya ang Tagalog sa NLI at taga-Samar-Leyte Visayas ang chairman nito. Napili ng NLI ang Tagalog na maging basehan ng wikang pambansa. Sinabi ng NLI sa resolusyong kanilang inilabas:<br />

"This conclusion represents not only the conviction of the members of the Institute but also the opinion of Filipino scholars and patriots of divergent origin and varied education and tendencies who are unanimously in favor of the selection of Tagalog as the basis of the national language as it has been found to be used and accepted by the greatest number of Filipinos not to mention the categorical views expressed by local newspapers, publications, and individual writers."<br />
<br />
Dahil sa rekomendasyon ng NLI, at utos ng batas at Konstitusyong 1935, pinroklama ni Quezon noong 1937 sa bisa ng Executive Order No. 134 na Tagalog ang maging basehan ng wikang pambansa.<br />
<br />
Imposibleng si Quezon ang may pakana ng lahat dahil magiging pangulo lamang siya pagkatapos magawa ang Konstitusyong 1935 at sinunod lamang niya ang Konstitusyon, batas, at rekomendasyon ng NLI. Kung sa mga linguistic test, totoo na ang Filipino at Tagalog ay iisang wika lamang dahil wala pang masyadong pinagkaiba (mutually intelligible, parehong grammar, at napakalapit na lexicon). Pero totoo nga ba?</div>

Ang kailangan lang natin malaman, sa depinisyon at sa batas, ang Filipino ay maaaring maging iba sa Tagalog. Ang Filipino ay "gawa-gawang" (synthetic/ nang dahil sa batas) wika lang naman e. Isang proyekto kumbaga. Ang proyektong Wikang Pambansa na tinawag na Filipino. Hindi pa natin naaabot yung Filipino na gusto natin kaya nga ang tingin natin parang pareho pa rin yung Filipino at Tagalog.<br />
<br />
<a name='more'></a>Bakit ba kailangan ng wikang pambansa? Ideal sana na ang wikang pambasa ay siya ring opisyal na wika. Ibig sabihin wikang ginagamit sa mga ahensya ng gobyerno, wika kung saan nakasulat ang mga batas at mga desisyon ng mga korte, at wikang pinantuturo sa paaralan. Ideal rin na ang wikang pambansa ay lingua franca o wikang naiintindihan ng lahat o ng pinakamarami.<br />
<br />
Napili noong 1937 na maging basehan ng wikang pambansa ang Tagalog dahil ito ang lingua franca noong panahong iyon at dahil pa sa ibang mga dahilan. Ngunit ngayon, ang Tagalog ay "patay" na. Masyado raw kasing naging purista (kung maririnig ninyo ang "malalim" o "matanda" o "lumang" Tagalog, ito 'yun) kaya hindi na katanggap-tanggap na wikang pambansa. Kaya sinimulan ang proyektong Filipino noong 1973 at noong 1987 ito naging Wikang Pambansa.<br />
<br />
Samantala'ng ang Filipino ay buhay. Bukas na bukas manghiram sa ibang mga wika pati na rin sa mga wikang dayuhan. Hindi katulad ng puristang Tagalog na umiimbento ng mga salita kahit mayroon na (salumpuwit kayo dyan? kahit may silya na). Kaya naririnig natin na "ano ang Tagalog ng berde?". Sa tinagal-tagal ng berde ay itinatakwil pa rin itong hindi Tagalog.<br />
<br />
Tagalog ako e. At hindi ako marunong magsalita ng iba pang wika sa Filipinas. Ang hirap namang talikuran ng sarili kong kasaysayan. Pero iyon ang totoo: baka hindi na ako marunong mag-Tagalog.<br />
<br />
Marami na rin sigurong Tagalog ang hindi marunong mag-Tagalog. Kaya inangkin nila ang Filipino at pinagkakamalan itong Tagalog. Nang magkaroon ng makabagong alphabetong Filipino, iyon na rin ang alphabetong Tagalog. Kapag may Filipino sa TV, radyo, o libro, Tagalog na rin iyan. Naglabas ang KWF ng Ortograpiya ng Wikang Pambansa, ganoon na rin siyempre ang ortograpiyang Tagalog. Minumulto kami ng Tagalog.<br />
<br />
Bakit ba naging napakalapit ng Tagalog sa Filipino? Dahil nga lingua franca ang Tagalog noong ginagawa ang Filipino, madali at maraming salitang Tagalog ang nakapasok sa Filipino. Pero ang Filipino ay hindi purong Tagalog dahil tanggap na ang silya at berde, malaya na ring nakapasok ang hello, shawarma, at kwarta. At ilang mga pag-aaral sa mga diksyonaryong Filipino ang nagsasabing wala nang 50% ng Filipino ang Tagalog lamang. Hindi ko na masabi man lang na "karamihan" sa Filipino ay Tagalog.<br />
<br />
Filipino na ang Wikang Pambansa. Filipino na rin ang lingua franca ng buong bansa. Filipino na rin sana ang maging nag-iisang opisyal na wika ng pambansang pamahalaan.<br />

next. I approached him to say hi and tell him I will use the equipment

long walk around. We sat and chat for a while near a school in the middle of

eating at places like that. Actually, I sometimes buy at the wet market on my

<span lang="EN-US">They invited me to try the gym where they
go. We agreed to meet there after lunch. That is the first time I entered Happy

<span lang="EN-US">I tried to follow their routine and incorporate
things I learned from my old gym and trainer. After our workout, Don invited us
to their house just at the street behind the gym. The entrance of their house
is from an elevated backyard. They only occupy the second floor.<o:p></o:p></span></div>

very comfortable. The airconditioner easily cooled the room. We started talking
about stuffs again. He has a pair of dumbbells and two big containers of whey.

<span lang="EN-US">They were shirtless as soon as we entered
the room. They persuaded me to remove my shirt too. They said it is bad to dry
sweat with shirt on and in an airconed room. I gave in. Rou then teased how my

<span lang="EN-US">It was not very long until Rou said goodbye
as he told us he is going to do stuffs. He told us to enjoy the rest of the
day. After a few minutes, Don and I lay on the bed and hugged. We started

The <a href="http://en.wikipedia.org/wiki/Motorized_tricycle_(Philippines)" target="_blank">tricycle</a> was about to turn right to our street when suddenly a boy riding a motorcycle to the opposite direction caught my glance. He turned his eyes at me too. The boy's hair seems fuzzy.<br />

My body switched position inside the tricycle to turn my head around. He was maneuvering his motorcycle back. The sun is still up but waning. I got off the tricycle a few houses away from home.<br />

The boy was still riding towards me but suddenly turned back again. I started walking home. I looked back and saw him stop his motorcycle. I slowly started walking towards the <a href="http://en.wikipedia.org/wiki/Sari-sari_store" target="_blank">sari-sari store</a>, near where the boy was.<br />

I approached his motorcycle looking at the people around if I could recognize someone or if someone was looking. He kept on looking at his side mirror towards my direction. I took glances at him.<br />

I passed by him and walked a few steps more to the store. Some were still buying. I looked back to him and his humble face. I walked back to him. I was unsure where to start. He knelt and started opening my shorts' button and zippers. "Wow. I'm ashamed of mine," he said. After some moments, he stood up and we kissed again. He removed my eyeglasses. His hugs and kisses were short yet hard.<br />

He pushed me to the bed. I reminded him we cannot take too much time. He continued with me. Then he started pulling his shorts down. I helped him. "Have you tried anal?" he asked. I just kept quiet.<br />

I tugged him out of the bed. He started frisking me. I pulled my shirt up. "You're hot," he said. I pulled his sando up too. My tongue laid on his nipple. He did the same to me after. I told him to finish. I knelt.<br />

We must presume that laws were made by Congress with good intention. Just because a law can be used in a corrupt manner does not imply its unconstitutionality.<br />

The chief-of-staff of the office of Senator Sotto admitted to the 'lifting' on behalf of their speech writers but defended that they were just
also quoting Dr. Natasha Campbell-McBride's book. I have not read the book and
so do not know the extent of similarity of the blog from the book.<o:p></o:p></div>

I find it personally difficult to accept that the speech writers and Sarah,
separately quoting a book, would produce very similar statements. 81-96% match
after a sentence per sentence comparison using a string similarity test which
could be found <a href="http://www.tools4noobs.com/online_tools/string_similarity/" target="_blank">here</a>.<o:p></o:p></div>

Plagiarism is not a crime. <b>There is no law that punishes plagiarism per se.</b> There is not even a standard legal definition of plagiarism. The court only borrows the definition from dictionaries or from academic institutions. The court could choose a lax definition or otherwise. The most comprehensive definition I encountered so far is from Harvey which I found in A.M. No. 10-7-17-SC (Sereno, J., dissenting), October 15, 2010:<br />

Forms of Plagiarism<br />There are many ways by which plagiarism can be committed. For the purpose of this analysis, we used the standard reference book prescribed for Harvard University students, "Writing with Sources" by Gordon Harvey.<br />Harvey identifies four forms of plagiarism: (a) <b>uncited data or information</b>; (b) an <b>uncited idea</b>, whether a specific claim or general concept; (c) an <b>unquoted but verbatim phrase</b> or passage; and (d) an <b>uncited structure or organizing strategy</b>. He then explains how each form or mode of plagiarism is committed. Plagiarism is committed in mode (a) by "plagiarizing information that is not common knowledge." Mode (b) is committed when "distinctive ideas are plagiarized," "even though you present them in a different order and in different words, because they are uncited."<br />
Even if there has been a prior citation, succeeding appropriations of an idea to make it appear as your own is plagiarism, because the "[previous] citation in [an earlier] passage is a deception." Mode (c) is committed when "you … borrowed several distinctive phrases verbatim, without quotation marks…" Mode (d) is committed when, though the words and details are original, "(y)ou have, however, taken the structural framework or outline directly from the source passage … even though, again, your language differs from your source and your invented examples are original." [emphases supplied]</blockquote>
Aside from the alleged plagiarism, could there be copyright infringement?<o:p></o:p></div>

Sarah posted the blog on February 23, 2011. The speech was
delivered more than a year after. It is safe to assume that the speech was only
written a few days before the delivery and never made available to the public prior to that. The Intellectual
Property (IP) Code of the Philippines provides:</div>

Section 172. Literary and Artistic Works. - 172.1. Literary and artistic
works, hereinafter referred to as "works", are original intellectual
creations in the literary and artistic domain <b>protected from the moment of their creation</b> [emphasis supplied]</blockquote>

We presume that Sarah made the blogpost about a year before the speech was written so she is the copyright holder.</div>

We now also know that Senator Sotto did not write the speech all by himself. Should Senator Sotto be responsible for what he did not entirely write? The moment he took the floor and started his speech, it is as if he is the one who made the speech. Senator Sotto, nonetheless, claims responsibility but defended that he
said a general disclaimer in the speech itself:</div>

The written speech, however, is confusing on where it is still the Senator's
words or the sources by not using quotation marks or blocking. There
was also no paraphrasing or correct citation, at least in the case of Sarah. Moreover, the general disclaimer is for the ideas and facts presented. The manner of expression is another thing. The IP Code also provides:</div>

Unprotected Subject Matter. - Notwithstanding the provisions of Sections 172 and 173, <b>no protection</b> shall extend, under this law, <b>to any idea</b>, procedure, system, method or operation, concept, principle, discovery or mere data as such, even if they are expressed, explained, illustrated or embodied in a work; news of the day and other miscellaneous facts having the character of mere items of press information; or any official text of a legislative, administrative or legal nature, as well as any official translation thereof. [emphases supplied]</div>

There are two types of copyrights. First are the economic rights which enumerates rights of the copyright holder so he can effectively exploit economically his works. The limitations of these rights were also provided:</div>

the closing paragraph of Senator Sotto's speech was copied and translated to

katapangan at paninindigan ang humuhubog sa kasaysayan ng sangkatauhan. Tuwing
naninindigan tayo para sa isang paniniwala, tuwing kumikilos tayo para mapabuti
ang buhay ng iba, tuwing nilalabanan natin ang kawalan ng katarungan,
nakalilikha tayo ng maliliit na galaw. Kapag nagkasama-sama ang mumunting galaw
na mga ito, bubuo ito ng isang malakas na puwersang kayang magpabagsak maging

dozens of countries. Thousands of unknown men and women in Europe resisted the
occupation of the Nazis and many died, but all added to the ultimate strength
and freedom of their countries. It is from numberless diverse acts of courage
and belief that human history is shaped. Each time a man stands up for an
ideal, or acts to improve the lot of others, or strikes out against injustice,
he sends forth a tiny ripple of hope, and crossing each other from a million
different centers of energy and daring those ripples build a current which can
sweep down the mightiest walls of oppression and resistance."</span></i></blockquote>

Senator Sotto defended that it was translated and therefore
not plagiarized. In the copyrights perspective,
translation is not an automatic defense. The IP Code provides:</div>

Chapter VIII, copyright or economic rights shall consist of the exclusive right
to carry out, authorize or <b>prevent</b>

<b>translation</b>, adaptation, abridgment,
arrangement or other transformation of the work; [emphases supplied]</div>

<span style="text-align: justify;">Senator Sotto then later added that it was texted to him by a friend and he did not know that it was from another speech.</span><br />
<div style="text-align: justify;">

Remedies for copyright infringement include filing of
criminal case as well as civil action. Could Senator Sotto be criminally or civilly
liable? I do not think so. Article VI of the 1987 Constitution of
the Republic of The Philippines provides:</div>

Section 11. No Member shall be questioned nor be held liable in any
other place for any speech or debate in the Congress or in any committee thereof.</blockquote>

Senator Sotto as a representative of the people is privileged.
In Osmeña, Jr. v. Pendatun, G.R. No. L-17144, October 28, 1960:</div>
<blockquote class="tr_bq" style="text-align: justify;">
Our Constitution enshrines parliamentary immunity which is a
fundamental privilege cherished in every legislative assembly of the democratic
world. As old as the English Parliament, its purpose "is to enable and
encourage a representative of the public to discharge his public trust with
firmness and success" for "it is indispensably necessary that he
should enjoy the fullest liberty of speech and that he should be protected from
resentment of every one, however, powerful, to whom the exercise of that
liberty may occasion offense."</blockquote>

The only recourse is the disciplining of his fellow senators if someone would pursue this. Article VI of the Constitution also provides:</div>

Without thinking, I walked for a kilometer and ride a jeep, Php 7 for 3 km. This is the shortest route by distance and it seems faster because I have no waiting time for the jeep to fill.</div>

It was a good excuse to hang out with this guy some more.<br />

We talked about those things a bit more. We walked past the gate, our meeting place, and the barangay hall. We were near their subdivision and I can sense his caution. I share the same with him. I thought we would walk straight through the main street when we suddenly took a turn. It was to their subdivision! I was puzzled why.</div>

Though it is another way to the national road and it is less likely that someone who can recognize me will pass through there, I did not thought he would choose that way. It is only half a kilometer to the national road and another half to Mcdo, just along the national road.</div>

It was not yet that late but there were few people and cars outside. It became different as we entered Mcdo. That store was recently renovated and now opens 24-hours. I looked around if I would recognize someone while we walked to the counter. I stared long up the menu. I am always like that.</div>

He was already taking his time. I was still cautious if there were onlookers. I was planning to check him out when suddenly a familiar faced guy showed up outside the store. My younger brother was next to him and their other barkada. It seems they will go inside.</div>

I do not know if I will stand up and go to the washroom but I did. Not a step more when C came out.</div>

"My brother is here," I said with a ghastly voice. I looked towards the group entering the store doors.</div>

He did not said anything to me and went straight to my brother. I do not know if I will grab his shirt or call him back. He talked to my brother and another of the group. They were having fun. He handed money to the other guy.<br />

My brother saw me and said, "Hey, you were also here?" Reply was not expected.</div>

I felt conspired upon. The group went to the counters. C returned back to me. I was expecting an explanation when he laughed.</div>

We sat down and sipped with our straw while my brother's friends sat at a table not so far.</div>

"That was my nephew," he began explaining. "And so you are our friend's brother?" He laughed again. "Who would have thought?"</div>

He apologized for being late. It was just a few minutes but it was not really comfortable waiting at that place.
